My Travel in Color is a free website for people in the United States and U.S. territories. By using the site you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use the site.
The site is offered only in the United States and U.S. territories (including Puerto Rico, Guam, the U.S. Virgin Islands, American Samoa, and the Northern Mariana Islands). We block traffic from other countries. Do not use a VPN or other tool to pretend you are in the United States.
You must be at least 13 years old to create or edit a map. The site is not for children under 13. If you are under 13, do not create a map. A parent or guardian may use the site for a family trip map. An allowed network does not change this age rule.
The site lets you color a map and save travel history (places, roads, flights, cruises, trains, and shapes). There is no fee to use the site. Features can change or stop at any time.
You might see maps with photos and writing on them. Those are admin maps at the moment. Visitors cannot upload photos. The writing feature is currently not available to visitors. They may be turned on in the future when more controls are in place.
If you have any issue with an admin photo or with writing on an admin map, enter it in Feedback or report the map.
You own the names, notes, and other content you add. You are responsible for that content. Do not upload anything illegal, harmful, or that you do not have the right to share. Every map is public and may be viewed by anyone in the United States and U.S. territories. Keep a backup. We are not required to keep a copy for you.
You grant My Travel in Color a license to host and display your content so the site can show your map.
Each map has its own password. That password is how you edit or delete that map. We cannot recover a forgotten password. Back up the map if you want your own copy.
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not promise that the site will always work, that maps will never be lost, or that colors, miles, or routes are exact.
TO THE FULLEST EXTENT ALLOWED BY UNITED STATES LAW, JOHN SCHMITZ AND MY TRAVEL IN COLOR ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL.
TO THE FULLEST EXTENT ALLOWED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THE SITE IS LIMITED TO THE AMOUNT YOU PAID US TO USE THE SITE IN THE 12 MONTHS BEFORE THE CLAIM. IF YOU PAID NOTHING, THAT AMOUNT IS $0, EXCEPT WHERE THE LAW DOES NOT ALLOW THAT LIMIT.
You agree to defend, indemnify, and hold harmless John Schmitz and My Travel in Color from claims, damages, and reasonable legal fees that come from your maps or photos, your breach of these terms, or your violation of someone else’s rights.
We may lock or delete a map, or block access to the site, at any time, including if these terms are broken, if a map is reported, or if we need to protect the site or other users. You may stop using the site at any time. Export a backup first if you want your own copy. We do not have to keep your data after a map is deleted or the service ends.
Every map is public. We may hide or delete a map that breaks these rules. A hidden map cannot be viewed until the admin clears it. Reports are reviewed by the site owner. A deleted map may not be recoverable.
These terms are governed by the laws of the State of Kansas, without regard to conflict-of-law rules. Courts in Johnson County, Kansas are the venue for disputes, except where the law does not allow that. If a court will not enforce part of these terms, the rest still applies.
YOU AND MY TRAVEL IN COLOR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY. YOU WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR ANY OTHER REPRESENTATIVE PROCEEDING. A court may not join your claim with anyone else’s claim or preside over any form of a representative or class proceeding. These terms do not require arbitration.
If this waiver is found unenforceable as to a particular claim, that claim must be severed and may proceed in court on an individual basis only, and this waiver still applies to all other claims.
We can change these terms or end the service at any time. The current terms on this page apply when you use the site.
If you believe a photo or other material on the site infringes your copyright, use Feedback and start the message with DMCA. Include the map link, the work you own, and your contact details. We will review it and remove the material if the claim is valid.
